On guarantees of gender (male and female) equality

LAW OF THE REPUBLIC OF AZERBAIJAN

 Article 1. The purpose of the law

The purpose of this law is to ensure gender equality by eliminating all forms of gender discrimination and creating equal opportunities for men and women in political, economic, social, cultural, and other spheres of public life.

 Article 2. Basic concepts

2.0. The following definitions are used in this law:

2.0.1. Gender – the social aspect of male-female relations in political, economic, cultural, and other spheres of public life;

2.0.2. Gender equality – equality of rights of women and men and equal opportunities for the realization of these rights and their equal social status in society;

2.0.3. Equal opportunities – equal conditions and guarantees created for women and men in the implementation of human rights;

2.0.4. Discrimination on the basis of sex – sexual harassment, any difference, exception, or preference that restricts or denies the equal exercise of rights on the basis of sex;

2.0.5. Sexual harassment – immoral behavior that degrades and insults a person in a labor or service relationship, arises from belonging to another sex or sexual orientation, and manifests itself in physical actions (touching, touching), obscene words, gestures, threats, defamatory offers or invitations.

Article 13. Equal opportunities in the realization of the right to education

13.1. The state provides for the creation of equal opportunities for men and women to exercise their right to education.

13.2. The employer must create equal conditions for men and women to receive basic and additional education, to exercise their right to education-related leave.

13.3. The state provides for the creation of equal opportunities for men and women in admission to all educational institutions, student scholarships, selection of the curriculum, and assessment of the knowledge, regardless of the type of property.

13.4. Textbooks should be based on the principle of gender equality.

 Article 14. Discrimination in the activities of educational institutions on the basis of sex

14.0. In the activities of educational institutions, the following cases can be considered as discrimination on the basis of sex:

14.0.1. Application of different requirements for men and women during admission, curriculum development, or knowledge assessment;

14.0.2. Creation of different opportunities for men and women in the choice of the field of education.
